On July 10th, 2018, a Labour Relations Board hearing was held between Mount Polley Mining Corporation and USW Local 1-2017. The Local alleged that the Employer breached Section 54 of the Labour Relations Code by failing to give 60 days' notice when it laid off a significant amount of its work force in January and February of 2018.
Although the Employer argued that they were unable to comply with Section 54 due to reasons beyond their control, the Adjudicator was not convinced. The Adjudicator ruled that damages in the form of lost wages to the Employees are appropriate to remedy a failure to provide notice as required. “It's an important win”, said Dan Will, Business Agent for members at Polley Mine. “The award will also benefit members that had to bump to lower paid jobs.”
